The problem 'can' be an internal component issue, or maybe a software issue...

It is too difficult to diagnose based on your description.  You may need to take it to a transmission specialist familiar with the CVT, or your local MINI dealership....

Take it to the dealer and trade it for anything not BMW MINI. Problem solved!

If you have the CVT automatic transmission, you are in trouble - they have proven to be very unreliable.  You did not say where you live, so we can't give you advise as to what mechanics or dealers you might get help from.
